Made in USA claims on Shopify product pages (FTC)

Unqualified “Made in USA” on a product page needs all-or-virtually-all U.S. content — or a clear qualified claim

Green Claims Guard (Shopify App Store) is a Shopify app that, as the live listing states, offers cited claim scans: it flags green-claim wording and names the exact provision it cites. The listing names a US pack for Made in USA origin claims under 16 CFR Part 323. It does not decide whether a product is all or virtually all made in the U.S., replace counsel, or certify a Made in USA claim. This page is not legal advice. Confirm the live listing; this guide does not add prices or a plan matrix.

Free check first: Green claim wording self-check runs in your browser and sends nothing. Paste product copy and see which environmental wording to review.

Job: if the product page (or a badge, seal, or equivalent mark on that page) says Made in USA or an equivalent unqualified U.S.-origin line, treat that as an advertising claim under the FTC’s all-or-virtually-all standard — or replace it with a clear qualified claim. That is not the same job as customs / duty country of origin, and not the EU generic-green-claims ban.

Unqualified “Made in USA” generally needs all or virtually all U.S. content

Confirm the live FTC Made in USA guidance (Complying with the Made in USA Standard) and the Labeling Rule text at 16 CFR Part 323. This page is not a substitute for either text, and it is not legal advice.

The FTC guidance: for a product to be called Made in USA, or claimed to be of domestic origin without qualifications or limits on the claim, the product must be all or virtually all made in the U.S. As that guidance and 16 CFR 323.2 put the same three-part test: the final assembly or processing of the product occurs in the United States, all significant processing that goes into the product occurs in the United States, and all or virtually all ingredients or components of the product are made and sourced in the United States.

16 CFR 323.1(a) treats “Made in the United States” as any unqualified representation, express or implied, that a product or service (or a specified component) is of U.S. origin — including that it is “made,” “manufactured,” “built,” “produced,” “created,” or “crafted” in the United States or in America, or any other unqualified U.S.-origin claim. Read the live rule; do not treat this paraphrase as the official text.

Labels, seals, and online product-page copy are not the same legal bucket — counsel still owns both

The Labeling Rule (16 CFR Part 323) applies to labels that make unqualified Made in USA claims. 16 CFR 323.3 also applies that label standard to mail-order catalogs and mail-order promotional material — including materials disseminated by electronic means — when they include a seal, mark, tag, or stamp labeling a product Made in the United States.

Section 5 of the FTC Act, and the FTC’s Made in USA Policy Statement described in the same guidance, still cover deceptive U.S.-origin claims in advertising and other promotional materials, including internet marketing. A Shopify product title, description, or theme badge can be an origin claim even when it is not a hang-tag. Keep counsel in the loop. This page is not legal advice.

If it is not all-or-virtually-all, use a clear qualified claim

The FTC guidance treats a qualified Made in USA claim as one that describes the extent, amount, or type of a product’s domestic content or processing — it indicates the product is not entirely of domestic origin. FTC-style patterns in that guidance include “Made in USA of U.S. and imported parts” and assembly-plus-source lines such as a product “assembled in USA” of named imported parts. Those are examples of shape, not copy you should paste. A qualified claim still has to be truthful and substantiated. Merchants confirm wording with counsel.

Native path: edit the product page; there is no Shopify Made in USA toggle

Shopify Admin has no “Made in USA compliance” switch. Open the product title, description, metafields, and any theme snippet or badge that states U.S. origin. Remove the unqualified line, or replace it with a clear qualified claim you can substantiate. Keep substantiation files offline (bills of materials, supplier origin statements, processing records) — they are not something Shopify stores for the FTC. Repeat when you add products or change suppliers.

App path: scan claim wording; the app does not prove manufacturing facts

Re-fetched at PR time, the Green Claims Guard listing still states: scan claims + cited rules; flags green-claim wording and names the exact provision it cites; US pack: Made in USA origin claims under 16 CFR Part 323. Use that path to find and flag origin-claim wording. The app does not decide whether the product is all or virtually all U.S.-made, does not inspect a factory, and does not certify the claim.

  1. Open the listing (apps.shopify.com/green-claims-guard) and install it on the store that shows Made in USA (or equivalent) on product pages.
  2. Run a scan of product titles, descriptions, and on-page badges. The listing’s job is to flag claim wording and name the provision it cites.
  3. For each flag: remove the unqualified line, or replace it with a clear qualified claim you can substantiate — with counsel, not this page.
  4. Re-open the live product page. Repeat when you add products or change sourcing.
