Right to Repair Directive Annex II
Annex II lists the Union acts that set repairability requirements. Article 5 follows that list
Direct answer. Annex II of Directive (EU) 2024/1799 is the “LIST OF UNION LEGAL ACTS LAYING DOWN REPAIRABILITY REQUIREMENTS.” Article 5(1) begins: “Member States shall ensure that upon the consumer’s request, the manufacturer shall repair goods for which, and to the extent that, repairability requirements are provided for by Union legal acts listed in Annex II.” The power to amend that list is Article 5(9), not Article 5(8). Quotes are the consolidated English text CELEX 02024L1799-20260731 (31 July 2026), the consolidation in force when checked on 13 October 2026. The Publications Office lists that text as a documentation tool. Row 11 was inserted by Commission Delegated Directive (EU) 2026/74. This page is not legal advice.

Checklist
- Start from Annex II. Article 5 and Article 6 apply only to goods covered by the acts on that list, and only to the extent those acts provide repairability requirements.
- Read row 11 as an inserted row. Rows 1 to 10 are the base text.
- Use Article 5(9) for the Commission’s power to update the list. Article 5(8) is a different sentence.
- Do not read a country’s transposition status off this page. That check is EUR-Lex national transposition.
Which text this page quotes
The quotes are the consolidated text of 31 July 2026 (02024L1799 — EN — 31.07.2026 — 001.001). The file’s own disclaimer says the consolidated text is a documentation tool and that the authentic texts are those in the Official Journal. The “Amended by” table names Commission Delegated Directive (EU) 2026/74 of 12 January 2026 (OJ L 74, 20.4.2026, p. 1). In the annex that act is marker M1, labelled INSERTED, and it adds row 11. Rows 1 to 10 have no amendment marker. Articles 1, 2, and 5 have no amendment marker. A corrigendum, OJ L 90789, 9.12.2024, p. 1 (2024/1799), is marker C1. In this consolidation that marker sits on the point Article 17 adds to Annex I of Directive (EU) 2020/1828. It does not mark Articles 1, 2, or 5, or Annex II.
Annex II, as written
The annex title is “ANNEX II” and the subtitle is “LIST OF UNION LEGAL ACTS LAYING DOWN REPAIRABILITY REQUIREMENTS.” Footnote numbers in the Official Journal are omitted here. The regulation number in each row is linked to its EUR-Lex ELI page. Row 11 keeps the final full stop that the consolidated text prints. Rows 1 to 10 do not end with a full stop in that text.

The footnote to row 8 names a longer product title, including smartphones and mobile phones other than smartphones. The row copied above is the Annex II line, not that footnote.
Article 5: the repair obligation, and who may amend the list
Article 5 is titled “Obligation to repair.” The first sentence of Article 5(1) is quoted in the opening paragraph. Article 5(8): “Without prejudice to the obligation to repair under this Article, consumers may seek repair from any repairer of their choice.”
Article 5(9): “The Commission shall adopt delegated acts in accordance with Article 20 to amend Annex II by updating the list of Union legal acts laying down repairability requirements in the light of regulatory developments. The Commission shall adopt such delegated acts without undue delay after publication of the respective Union legal act, and at the latest 12 months after such publication.”
Article 20 refers to the power in Article 5(9). Delegated Directive (EU) 2026/74 is an act that has already amended Annex II, by inserting row 11. This page found that amendment in the 31 July 2026 consolidation. It did not find a later consolidation on 13 October 2026.
Where the manufacturer obliged to repair is established outside the Union, Article 5(3) says: “Where the manufacturer obliged to repair pursuant to paragraph 1 is established outside the Union, its authorised representative in the Union shall perform the obligation of the manufacturer. Where the manufacturer has no authorised representative in the Union, the importer of the good concerned shall perform the obligation of the manufacturer. Where there is no importer, the distributor of the good concerned shall perform the obligation of the manufacturer.”
Scope: Articles 1 and 2
Article 1(1): “This Directive lays down common rules strengthening the provisions related to the repair of goods, with a view to contributing to the proper functioning of the internal market, while providing for a high level of consumer and environmental protection.”
Article 1(2): “This Directive shall apply to the repair of goods purchased by consumers in the event of a defect of the goods that occurs or becomes apparent outside the liability of the seller pursuant to Article 10 of Directive (EU) 2019/771.”
Article 1(3): “Articles 5 and 6 shall only apply to goods for which and to the extent that repairability requirements are provided for by Union legal acts listed in Annex II.”
Article 1(4): “This Directive is without prejudice to Directive (EU) 2018/958.”
Article 2(9): “‘goods’ means ‘goods’ as defined in Article 2, point (5), of Directive (EU) 2019/771 except water, gas and electricity;”
Article 2(11): “‘repairability requirements’ means requirements under the Union legal acts listed in Annex II which enable a good to be repaired, including requirements to improve ease of disassembly and requirements concerning access to spare parts, repair-related information and tools applicable to goods or specific components of goods;”
Transposition
Article 22 is titled “Transposition.” Article 22(1) begins: “Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 31 July 2026 at the latest.” The same article says: “Member States shall apply those measures from 31 July 2026.” Those are dates in the directive.
